Issues

For years, individuals who use wheelchairs have complained about not being able to get front row seats at Red Rocks Amphitheatre, when the front row and back row are the only two options for wheelchair seating. CREEC, DLA and CCDC joined forces filed a lawsuit against the City for it to make changes to its policies and practices regarding accessible seating tickets at Red Rocks. 

Status

CCDC, CREEC, with Amy Robertson as lead counsel,and Disability Law Colorado wrote a letter to the City & County of Denver's City Attorneys' Office on August 26, 2016 attempting to resolve the issues. We received a letter in response.. Those letters are attached below.

On December 1, 2016, the coalition of disability rights organizations filed suit against the City alleging violations of the ADA in its seating and ticketing practices at Red Rocks. Front row wheelchair seating was being purchased by entities that were not individuals who use wheelchairs who needed front row seating, and these entities were reselling the tickets to the general public on other websites and by other means, preventing people who use wheelchairs will only have two options for wheelchair seating (the first row and the last row) from getting the Front row seats. The case became a class action.The case was consolidated with another case that challenges Red Rocks inaccessibility, 16-cv-02565-WYD-MJW. On April 28, 2017, the parties reached a settlement in the case. Preliminary approval of the class action Consent Decree was given by the Court on March 6, 2018. The Notice of Proposed Settlement of Class Action Lawsuit is posted below. A hearing on final approval of the class action settlement is set for June 7, 2018 at 10:00 a.m. in Courtroom A-1002 in the Alfred A. Arraj United States Courthouse, located at 1900 19th St., Denver, Colorado, before Senior United States District Court Judge Wiley Daniel.

On June 7, 2018, the Court granted Final Approval of the Class Action Settlement. See the Consent Decree signed by the Court posted below. The Final Media Release is also available.
